Employment Rights Act: What are the upcoming October changes?
PinnedWhat's changing?
The Employment Rights Act 2025 will strengthen employers' duty to prevent sexual harassment, raising the bar from "reasonable steps" to "all reasonable steps." It will also introduce employer liability for third-party harassment, for example by customers or contractors. The government is targeting October 2026 for the change to become law.
Our Bullying and Harassment, Sexual Harassment and Employment Rights Act for Managers content will likely need to reflect this change. We will have a full list of courses this affects soon.
We only update course content once a change is legally in force, so the updated content will be released after commencement, not before. That way you can trust the content always reflects the current legal position.
Your existing content remains fully accurate and compliant until then. Once the change comes into force, our team will be working to get the updated content live within two weeks. We'll confirm the exact commencement date as soon as it's finalised. A further update is expected in 2027 once supporting guidance is published.
